Quotes from photos are free. Once a technician is dispatched to your property a mandatory, non-refundable dispatch fee applies, whether or not the work goes ahead. Work outside 8:00 AM - 4:00 PM on weekdays, and any weekend or holiday work, is billed at emergency rates.
This General Service & Terms of Agreement ("Agreement") is entered into by and between FlowState Mechanical LLC ("Company") and the undersigned customer ("Customer"). By requesting on-site service, authorizing work, or executing this document, Customer agrees to be legally bound by all terms, conditions, and operational policies outlined below.
1. Dispatch fees, quoting & operational policies
Mandatory Dispatch Fee: An on-site dispatch fee applies immediately when a technician arrives at the Customer property. This dispatch fee is mandatory, fully non-refundable, and will be charged regardless of whether the scope of work is completed, structurally possible, or takes minimal time to evaluate.
Remote Photo Quotes: Free promotional quotes are strictly limited to remote evaluations where the Customer submits photos, dimensional layouts, and clear scopes of work digitally. Any physical dispatch to a site to diagnose or quote an issue triggers the mandatory dispatch fee.
Emergency Hours & Rates: Standard business operating hours are Monday through Friday, 8:00 AM to 4:00 PM. Any dispatch, diagnostics, or active repair services requested or performed after 4:00 PM and before 8:00 AM on weekdays, or at any time on weekends and officially recognized holidays, shall be designated as Emergency Work and billed at the Company's premium emergency hourly rates.
Card on File Pre-Authorization: For all emergency dispatch requests, the Customer must provide a valid credit card to be placed securely on file. The mandatory dispatch fee will be processed and cleared prior to the vehicle departing the Company shop.
2. Estimates, deposits & payment terms
Job Deposits: Any job or project estimate totaling $1,000.00 or more requires an upfront deposit as specified by the Company before any materials are sourced or labor scheduled, unless expressly noted otherwise in writing by a Company officer.
Payment Obligations: All balances are due immediately upon completion of services rendered. Payment must be made directly to the on-site technician via credit card, check, or pre-arranged electronic transfer.
Late Fee Penalties: Any balance remaining unpaid past the designated due date shall instantly accrue interest at a rate of 1.5% per month (18% per annum), calculated and compounded daily from the date of completion until fully paid.
Collection Costs: In the event the Company must hand over an outstanding balance to a collections firm or retain legal counsel to recover debt, the Customer explicitly agrees to assume full liability for all collection agency fees, court costs, administrative assessments, and reasonable attorney fees.
3. Limited warranty & exclusions on old infrastructure
One-Year Labor Warranty: The Company guarantees its workmanship on brand-new plumbing and heating infrastructure installed by its technicians for a period of one (1) year from the date of project completion. This warranty covers labor exclusively and does not extend to equipment or materials covered under separate manufacturer warranties.
Existing Tie-In & Connection Exclusion: The Company explicitly excludes from its warranty any physical point of connection - including but not limited to ProPress couplings, solder joints, compression fittings, or threaded adaptations - made between brand-new materials and pre-existing, older plumbing, heating, or gas piping. If a connection is made to old piping (e.g., degraded copper, rusted iron, scaled steel) and initially holds but subsequently drips, leaks, or fails due to the underlying condition, brittleness, scale buildup, or metallurgical weakness of the pre-existing pipe, the Company shall have zero liability. Repairing or modifying such failures will be treated as an entirely separate, fully billable service.
4. Water mitigation, hazards & site conditions
Pre-Existing Utility & Valve Failures: To perform work safely, technicians must often cycle or shut off old shut-off valves, main water valves, or gas cocks on the property. If an older, pre-existing valve is frozen, seized, degrades, or snaps upon operational manipulation, the Company is completely exempt from liability for the component failure or any resulting water/gas bypass. Re-piping or replacing faulty structural shut-offs will be billed additionally.
Water Damage & Mold Disclaimer: The Company is not responsible or legally liable for any pre-existing water damage, dry rot, structural deterioration, or mold growth discovered behind walls, inside ceilings, or beneath flooring during structural access. The mitigation, abatement, and restoration of environmental mold or structural decay remain the exclusive financial responsibility of the Customer.
5. Heating, gas & oil burner specific clauses
Combustion Dynamics & Secondary Failures: When firing up, adjusting, or pressurizing older boiler or furnace equipment, internal dynamics alter dramatically. The Company is not liable for secondary component failures - such as weak expansion tanks, ancient zone valves, seizing circulator pumps, or fragile heat exchangers - triggered naturally when a heating system is brought back up to proper legal operating pressures, temperatures, or combustion specs.
System Blockages & Sludge: The Company assumes no liability for underlying performance issues arising from pre-existing system sludge, heavy mineral scale crystallization, blocked oil/fuel delivery lines, or restricted heat exchangers that compromise total heating efficiency.
Safety Emergency Shut-Down Protocol: If a Company technician uncovers an immediate safety code hazard, unsafe carbon monoxide emission profile, or live gas/fuel line leak, the technician retains the absolute legal right to shut down, lock out, and red-tag the affected equipment for health and life safety preservation. The Company will not be held liable for any loss of heat, secondary frozen pipes, or inconvenience caused by a safety-mandated system shutdown.
